Agreement to These Terms
These Terms of Service and End User License Agreement (“Terms”) govern access to and use of Review Shark websites, web applications, mobile interfaces, software, APIs, dashboards, review response tools, support services, and related features. By creating an account, using the service, or allowing an authorized user to use the service on your behalf, you agree to these Terms.
Eligibility and Accounts
You may use Review Shark only if you can form a binding contract and are authorized to act for the business or organization connected to the account. You are responsible for maintaining accurate account information, protecting credentials, managing authorized users, and all activity under your account.
Service Description
Review Shark helps businesses monitor Google Business Profile reviews, prepare and manage response workflows, analyze review activity, route approvals, and administer related customer-support operations. AI-assisted drafting and automation features may produce suggested text, classifications, summaries, or workflow recommendations. You are responsible for reviewing and approving public responses before use unless you have expressly enabled an automation that permits posting under your account authority.
End User License Agreement
Subject to your compliance with these Terms and payment obligations, Review Shark grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the web and app interfaces solely for your internal business purposes. Review Shark and its licensors retain all rights, title, and interest in the service, software, design, workflows, documentation, and underlying technology.
You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, attempt to extract source code from, bypass technical limitations of, or create derivative works from the service except to the extent applicable law prohibits such restrictions.
Acceptable Use Policy
You agree not to misuse Review Shark or allow anyone else to misuse it. Prohibited conduct includes:
- Spamming, scraping, credential stuffing, probing, vulnerability scanning without authorization, or overloading the service.
- Submitting fraudulent reviews, fake business data, impersonated users, deceptive content, or unlawful instructions.
- Using the service to harass, threaten, discriminate, defame, or violate privacy or intellectual property rights.
- Bypassing rate limits, access controls, security measures, consent controls, or payment obligations.
- Reverse engineering, copying, reselling, or benchmarking the service for competitive purposes without written permission.
- Using automated outputs without appropriate human review where review is required by law, platform policy, or your own business obligations.
Billing, Renewals, Cancellations, and Refunds
Paid plans are billed on a subscription basis according to the plan, billing cycle, and price presented at checkout or in an order form. By subscribing, you authorize recurring charges until cancellation. Taxes, payment processor fees, and currency conversion charges may apply.
You may cancel future renewals through the billing or account settings flow when available, or by contacting support. Cancellation stops future renewal charges but does not automatically refund amounts already paid. Unless a separate written agreement or legally required rule says otherwise, subscription fees are non-refundable and access continues through the paid billing period.
Review Shark may suspend or terminate access for unpaid invoices, chargebacks, violation of these Terms, security risk, legal requirement, or misuse. You remain responsible for fees incurred before suspension or termination.
Third-Party Services and Platform Rules
Review Shark integrates with third-party services such as Google Business Profile, hosting providers, authentication providers, payment processors, analytics tools, AI sub-processors, and communication providers. Your use of connected third-party services may be governed by their separate terms, policies, permissions, quotas, and API limitations.
Review Shark is not responsible for third-party downtime, API rate limits, account suspensions, policy changes, data availability, or errors outside our reasonable control.
Customer Content and Permissions
You retain ownership of business data, review data, instructions, messages, and other content you submit or authorize Review Shark to process. You grant Review Shark the rights necessary to host, process, transmit, display, analyze, and create outputs from that content to provide and improve the service, comply with law, and enforce these Terms.
You represent that you have the rights and permissions needed to connect business profiles, process review data, authorize team users, and use automated or AI-assisted features.
Disclaimers
The service is provided “as is” and “as available.” To the maximum extent permitted by law, Review Shark disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and uninterrupted operation. AI-assisted outputs may be inaccurate, incomplete, inappropriate, or require editing. You are responsible for final decisions and public communications.
Limitation of Liability
To the maximum extent permitted by law, Review Shark will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits; lost revenue; lost data; reputational harm; business interruption; downtime; API rate limits; processing errors; delayed or failed review responses; or third-party service failures.
To the maximum extent permitted by law, Review Shark’s total liability for all claims relating to the service will not exceed the amounts you paid to Review Shark for the service in the three months before the event giving rise to the claim, or $100 if you did not pay for the service.
Indemnification
You agree to defend and indemnify Review Shark from claims, damages, liabilities, costs, and expenses arising from your content, your use of the service, your connected third-party accounts, your violation of these Terms, or your violation of law or third-party rights.
Changes to the Service or Terms
We may update the service and these Terms from time to time. Material changes will be posted on this page or communicated through reasonable means. Continued use after changes become effective means you accept the updated Terms.
